©2026 Seyfarth Shaw LLP EEOC-INITIATED LITIGATION: 2026 EDITION | 74 F. Transportation & Logistics In 2025, the EEOC filed several lawsuits against Transportation and Logistics companies on various grounds. The EEOC focused on disability discrimination, as in prior years, though some filings have emphasized the agency’s new focus on religious discrimination and ensuring employers follow the higher burdens for denying religious accommodation requests under the Groff test. KEY CASES FILED IN FY 2025 EEOC v. DHL Supply Chain USA, Case No. 3:25-cv-01987 (N.D. Tex.). On November 13, 2025, the EEOC filed a lawsuit alleging that DHL Supply Chain USA violated Title VII of the Civil Rights Act of 1964 by subjecting female employees to sexual harassment and retaliating against those who complained. According to the EEOC, a male supervisor at DHL’s Dallas-area facility repeatedly made unwelcome sexual comments and advances toward female workers. When employees reported the harassment, DHL allegedly failed to take corrective action and instead retaliated by reducing their hours and terminating some complainants. The EEOC claims this conduct constitutes unlawful harassment and retaliation. EEOC v. Alliance Ground International, LLC, Case No. 1:24-cv-05678 (N.D. Ill.). On November 13, 2025, the EEOC announced that Alliance Ground International agreed to pay $70,000 and provide injunctive relief to settle a lawsuit alleging disability discrimination under the Americans with Disabilities Act (ADA). The EEOC claimed that the company refused to hire an applicant for a cargo agent position because of his disability, despite his qualifications and ability to perform the essential job functions with reasonable accommodation. Under the consent decree, Alliance Ground International will revise its hiring policies, provide ADA training to managers and HR staff, and report compliance to the EEOC for monitoring. EEOC v. Gamer Logistics, LLC, Case No. 4:25-cv-01234 (S.D. Tex.). On November 13, 2025, the EEOC filed a lawsuit alleging that Gamer Logistics violated the Age Discrimination in Employment Act (ADEA) by refusing to hire a qualified applicant because of his age. According to the EEOC, the applicant, who was in his 50s, applied for a dispatcher position and met all qualifications. The company allegedly told him it was seeking “younger” candidates and hired substantially younger individuals instead. The EEOC claims this conduct constitutes unlawful age discrimination. The suit seeks back pay, liquidated damages, and injunctive relief, including policy changes and training to ensure compliance with the ADEA. 7 Transportation and Logistics Industry Merit Cases Filed in FY 2025 Chicago Dallas Charlotte Houston Miami Phoenix 1 2 1 1 1 1 EEOC District Offices Bringing Suit & Number of Lawsuits Brought by Each District Statutory Basis for Suit 3: ADA 2: Title VII 1: ADEA 1: PWFA ©2026 Seyfarth Shaw LLP
